PANIC MODE ACTIVATED! Phil Godlewski wants a do-over!

Asks Judge to Let Him Appeal SHOCK Rulings NOW!

Lackawanna County, Pennsylvania - The legal saga between Philip Godlewski and Brienna DuBorgel continues, with the latest move coming from Godlewski's camp. Following the court's significant April 17, 2025 rulings on summary judgment motions, Godlewski has filed an "Application for Amendment of Order". In plain terms, he's asking the judge to modify the previous order to allow him to immediately appeal certain key decisions to a higher court before the case proceeds to a full trial.

PANIC MODE ACTIVATED: Godlewski's lawyers just slapped down papers demanding the judge let them run screaming to the appeals court RIGHT NOW! All before this case even goes to a jury trial!

Why the panic?

Typically, appeals happen only after a final judgment concludes the entire case at the trial level. However, Pennsylvania law allows for earlier "interlocutory" appeals under specific circumstances, usually involving critical legal questions where an immediate appellate ruling could potentially save time and resources or even end the case sooner.

Godlewski wants the court to certify two specific issues for immediate appeal:

  1. Statute of Limitations: The court previously ruled that DuBorgel's counterclaims (including assault, battery, and emotional distress) were not barred by the statute of limitations, applying an extended timeframe relevant to childhood sexual abuse allegations. Godlewski disagrees and wants an appellate court to review this decision now.

  2. Effect of Prior Guilty Plea: The court determined that Godlewski's earlier guilty plea to corruption of minors meant he effectively admitted to sending certain explicit text messages mentioned in that criminal case's affidavit. This finding was crucial in the court's decision to dismiss Godlewski's own defamation and false light claims against DuBorgel. Godlewski contests this interpretation and seeks immediate appellate review.

The judge ruled Godlewski's old guilty plea admitted he sent those X-rated texts, which killed his defamation suit. Godlewski desperately wants the appeals court to undo that finding.

What's next?

This filing is simply Godlewski's request to the trial judge (Judge Gibbons) to amend the April 17 order with language permitting the appeal.
The court will likely require DuBorgel's response and potentially hold arguments before deciding whether to grant Godlewski's application.
If granted, it would pause the trial proceedings on those specific issues while they go up to the Superior Court. If denied, the case would likely continue towards trial on the remaining claims as outlined in the original April 17 order.
