Halle Berry is seeking sole custody of her 10-year-old son, Maceo.
The Academy Award-winning actress filed court documents alleging that the child’s father, French actor Olivier Martinez, is a hindrance to the child’s “best interests.”
Berry is requesting custody “or in the alternative, tie-breaking authority to make all decisions” about her son’s education, health and therapy needs, per legal documents obtained by People. The 58-year-old star claims she “is not perfect” but is “always seeking to prioritize the best interests” of her son.
The filing mentioned the child’s “educational challenges” and other concerns the actress had as she “fought for tutoring, an educational assessment and finding an environment that was suitable to Maceo’s needs.”

“[Martinez’s] actions and lack of cooperation with respect to Maceo’s psychological and educational needs have been detrimental to Maceo’s health and welfare,” the filing states. “Respondent’s refusal to allow early interventions have caused Maceo to fall further behind in school, caused Maceo’s acting out behaviors to worsen, and caused further damage to Maceo’s and Petitioner’s relationship,” Fox News reported.
The document includes Berry’s claims that Martinez has been “oppositional, unmoving and withheld his consent for years.”
“Because of [Martinez]’s opposition to any interventions whatsoever for years and because of [Martinez]’s prioritizing soccer activities over Maceo’s educational and psychological well-being, Maceo’s educational and behavioral challenges worsened, and he continued to fall further behind in school,” the document states.
Berry claimed Maceo would “act out” toward her after “longer periods of custody” with his father. She also stated that Martinez said Maceo was “old enough to make his own decisions.”

Berry and Martinez finalized their divorce last year following a lengthy court battle. The actress was ordered to pay her ex-husband close to $8,000 monthly for child support in addition to 4.3% on any income she makes over $2 million, per Fox News. Berry also pays for Maceo’s private school tuition, extracurriculars, and health care.
The actress previously went through a messy custody battle with her previous ex-husband, Gabriel Aubry, over their daughter. Their fight turned physical in 2012 when Aubry was arrested following an altercation stemming from him wanting to keep Berry from taking their daughter to France to live with Martinez, who she was dating at the time.
